Former Mississippi Supreme Court Justice on Initiative 65 Lawsuit

Some state leaders have suggested that if the MS Supreme Court rules that the ballot initiative process used to gather signatures for Initiative 65 is ruled unconstitutional, it could affect past ballot initiatives.  During an interview on “The Gallo Show” on SuperTalk Mississippi this morning, former state Supreme Court Justice Randy Pierce told us he doesn’t think that will happen.

“The court’s going to rule very narrowly only on the issue before it,” he predicted.  “Unless somebody challenges some previously approved initiative, then you won’t see that before the court.  My anticipation is that the opinion won’t even mention previous initiatives. ”

If someone does challenge a previously approved initiative in the future, Pierce told us the court could say, “Well you waited too long, that should have been already addressed.”

Pierce believes if the court does rule the ballot initiative process used to gather signatures for Initiative 65 is ruled in error, it will negate the medical marijuana vote, but not initiatives passed before that.
