A Salvadoran man who had previously been removed from the U.S. is behind bars in Madison County after allegedly sexually assaulting a woman.
Madison police report that dispatch received a call regarding an unidentified female who had been assaulted at Fernando’s Restaurant on Colony Crossing Way. An investigation spurred by law enforcement determined that Jose Rigoberta Meija-Cubias, 37, was responsible for the crime.
The individual was located at the local Mexican restaurant and handcuffed while a search warrant was being conducted at the establishment.
According to police, while at the scene, investigators came into contact with several suspected undocumented immigrants who were employed at the restaurant. Federal immigration and customs enforcement agents responded to the location and placed seven suspected to be lacking proper documentation into custody.
As for Meija-Cubias, he is charged with sexual battery of a physically helpless person and tampering with evidence. He will be housed at the Madison County Detention Center as he awaits his initial appearance in municipal court.
Meija-Cubias case will then be presented to the Madison County grand jury before District Attorney Bubba Bramlett. Federal immigration officials have placed a detainer on the subject as he was previously deported in 2010.
